The Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 (Act) expressly prohibits sexual harassment in the workplace. In addition, these amendments modify the way in which sexual harassment matters can be handled by the Fair Work Commission, Fair Work Ombudsman and the Courts.
The prohibition of sexual harassment in the workplace extends to all defined as workers, including but not limited to employees, contractors and volunteers.
Importantly, the Act allows for the Fair Work Commission to deal with sexual harassment, including stop orders, managing disputes and ordering compensation.
These amendments are extensive and complex, they can include the management of claims dating back prior to the commencement of the Act.
These changes to the legislation commenced on 6 March 2023.
